Free to Learn Ltd is the owner of this Website and the Free2Learn trademark and brand, and ‘you’ means the user of this Website. We reserve the right to withdraw all or part of the Website at any time.
By using this Website you agree to be bound by these Terms and the Privacy Policy.
You acknowledge that you are responsible for making back-up copies of all your data and taking appropriate precautions against viruses, hacking and other types of computer misuse.
Whilst we try to ensure that the Website does not contain any error, defect, malfunction or corruption, we do not accept responsibility for any damage to or loss of data on your computer system, network or server that results from accessing, downloading or other use of the Website or any materials made available via the Website (except for death or personal injury caused by our negligence).
We cannot promise that access to the Website will be uninterrupted or error free. We reserve the right to suspend access to the Website between a scheduled maintenance window each day if necessary. You accept that you will not have a claim for breach of contract (either against Free to Learn Ltd or your Service Provider / Free to Learn Ltd training or advice centre) or otherwise in respect of such period of unavailability. You also acknowledge that we cannot be held responsible for any delay or disruptions that are inherent in the operation of the Internet and the World Wide Web, including viruses.
Purpose of the Website
The purpose of the Website is to provide businesses, colleges or Further Education centres and individuals or ‘candidates’ with information on; the range of courses, training and or advice centres, training courses or ‘products’ and other services offered by or via Free to Learn Ltd, including enrolment, in England, Wales and Northern Ireland.

Our Liability to You
We will not be liable if we cannot provide the services to you because of an event beyond our reasonable control. If we are prevented from providing the services by such an event, we will take all reasonable steps to try to reinstate the provision of the services to you as soon as is reasonably practicable.
In no event will we be liable for any loss of profit, loss of earnings, loss of anticipated savings, loss of revenue or loss of goodwill that you may suffer. In no event will we be liable to you for any indirect or consequential loss that you may suffer.
The exclusions and limitations of liability contained in these Terms do not apply to any loss or damage resulting from death or personal injury caused by our negligence, loss or damages arising from our fraudulent misrepresentation, or any other losses which may not be excluded or limited by law.

Any link (including without limitation any links posted by other users of the Website) are provided for your convenience only and are accessed at your own risk. We are not responsible in any way for the content of any third party website or for goods or services provided by the operators of such websites, and, unless otherwise stated are not responsible for and do not endorse or recommend any third party website or its availability or contents or any agreement or understanding you enter into with a third party through a third party website. Free to Learn Ltd does not accept any liability for any loss, damage, expense, costs or liability whatsoever incurred by you in respect of these third party websites.
Privacy and Data Protection
We treat your privacy very seriously. The information, which may include sensitive personal data, that you provide to your service provider when you enrol for a Free to Learn Ltd course or at any other time is subject to the Free to Learn Ltd Privacy Policy. Please read this. You can find it at the foot of most of the Website pages. It sets out what information we collect, when we collect it, what we use it for, and who we can give it to. If you would like further details about the information we collect and how it is used, please ask your trainer.
While you are a Free to Learn Ltd candidates, you will receive information from us about your training or your course, and your trainer and the advisors at the training centre will be in touch with you to support you on your course. You will agree with your trainer how you want to receive this training support.

Amendments to the Terms
We reserve the right to amend these Terms from time to time. When we make a change we will update this page of the Website. If we do so, the updated version will be effective as soon as it is uploaded on to this Website. The date of the last revision to these Terms is provided at the end of the Terms. We recommend that you visit this page each time you visit the Website to ensure that you are aware of and are complying with any changes that we have made to these Terms. If you continue to use the Website you will be deemed to have accepted those changes from the point at which these changes come into effect.
General
We shall not be liable to you for any of the following types of loss or damage arising out of or in connection with your use of the Website or any or content and/or facilities provided via the Website :
any loss of profits, loss of earnings, loss of anticipated savings, goodwill or revenue;
any loss or corruption of data; or
any indirect or consequential loss.

The receiving and use of Free to Learn Ltd services is personal to you and you may not transfer your rights to access the course materials or to receive the services to another person unless we have consented in writing to you doing so.
If any provision of these Terms becomes void or otherwise unenforceable in whole or in part, the validity of the remainder of these Terms shall not be affected.
If either we or you fail to enforce, or delay in enforcing, any of our respective rights or remedies under these Terms, such failure or delay shall not operate as an agreement to waive that right or remedy, and shall not prevent us from exercising that right or remedy in the future.
These Terms and the terms and conditions of the Learning Agreement are governed by and will be understood in accordance with English law. The contract between us is concluded in the English language. Any dispute arising between us under or in connection with these Terms and the terms and conditions of the Learning Agreement shall be subject to the non-exclusive jurisdiction of the English courts.
These Terms constitute the entire agreement between us in relation to the provision by us to you of the Website, and they replace and supersede any prior arrangements between us in relation to the Website.
You acknowledge that you are not relying on any statement made by us or any of our representatives with regard to the Website other than those expressly set out in these Terms and the terms and conditions of the Learning Agreement. Nothing in this Paragraph shall exclude or restrict our liability for fraud or fraudulent misrepresentation.
The agreement between us which is comprised of these Terms and the terms and conditions of the Learning Agreement is not intended to be for the benefit of any third party, and shall not be exercisable by any other person under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
